PROFILE

We are currently seeking an experienced Litigation Law Clerk to work within our Advocacy department and specifically on insolvency and commercial litigation matters. The successful candidate will be proactive, have a strong work ethic and an ability to work effectively, both independently and as part of a team. Experience with insolvency proceedings under the Bankruptcy and Insolvency Act (BIA) and the Companies’ Creditors Arrangement Act (CCAA) is ideal, but not a strict requirement. Also, familiarity with creditor-driven legal proceedings such as receivership applications and bankruptcy proceedings in Toronto, Hamilton, Brampton and London courts is welcome. We welcome those who have a passion to learn about new ways of doing work including involvement with industry leading legal software and AI under the supervision of a senior lawyer.

RESPONSIBILITIES

  • Organizes and manages litigation files, including use of litigation management software like ACL.
  • Calculates litigation timelines, maintains due case reports and ensures deadlines are met.
  • Liaises with clients, administrative assistants and professionals.
  • Communicates in writing and in person with Court staff, fostering a co-operative relationship.
  • Drafts or assists in drafting court documents such as Affidavits, Motions, Affidavits of Documents, Bills of Cost, Factums, etc.
  • Familiarity with Westlaw and Quicklaw to access cases would be ideal but not required.
  • Attends to service and filing of court documents.
  • Remains current on court practices and practice notices from the Courts especially in the Hamilton, Toronto, Brampton and London regions.
  • Creates a document database, cross-references production and exhibit documents and maintains copies of transcripts for searching purposes using litigation software such as Relativity.
  • Organize cases for motions and trials; assists in setting up courtrooms and electronic access during trials.
  • Provides litigation support prior to and during motions, trials and hearings. Organizes attendance of witnesses.
  • Reviews transcripts to summarize and prepare lists of outstanding items.
  • Assembles answers to undertakings.
  • Files and serves documents in Canada and arranges for services abroad.
  • Prepares charts, chronologies and summaries of documentary evidence for use on discovery and trial.
  • Any other duties as required.

QUALIFICATIONS

  • Law Clerk diploma and a minimum of five years of legal experience as a Law Clerk/Paralegal combined with knowledge of current legal policies and procedures.
  • Experience with Federal and Ontario Courts.
  • Expertise in Microsoft Office Suite (particularly Word and Excel), Kofax and Adobe.
  • Strong written and verbal communication skills.
  • Strong organizational, time management and problem-solving skills.
  • Experience in Relativity.
  • Experience with document management software such as iManage.
  • The ability to effectively handle large volumes of work.
  • The ability to work independently as well as actively participate in and support a large team.
